1. Agreement to Terms
By accessing or using Sayify.pro ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Service Description
Sayify.pro provides a voice response collection platform that enables:
- Creation of public feedback links for voice response collection
- Automatic transcription of voice recordings
- Workspace management and team collaboration
- Analytics and reporting features
- Integration with third-party services via API and webhooks
3. User Accounts
3.1 Account Creation
- You must be at least 18 years old to create an account
- You must provide accurate, current, and complete information
- You are responsible for maintaining account security
- You are responsible for all activities under your account
- One person or entity may maintain only one free account
3.2 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.
4. Acceptable Use Policy
4.1 Permitted Uses
You may use our Service for lawful business purposes including customer feedback, surveys, interviews, and voice data collection.
4.2 Prohibited Activities
You may NOT use our Service to:
- Violate any laws or regulations
- Collect sensitive personal information without proper consent (e.g., health records, financial data)
- Harass, abuse, or harm others
- Distribute spam, malware, or phishing content
- Impersonate others or misrepresent your affiliation
- Interfere with or disrupt the Service
- Attempt unauthorized access to our systems
- Scrape or data mine without permission
- Resell or redistribute the Service without authorization
5. Subscriptions and Billing
5.1 Subscription Plans
- Free Plan: Limited features, no credit card required
- Paid Plans: Monthly or annual billing, billed in advance
- Enterprise Plans: Custom pricing, annual contracts
5.2 Payment Terms
- All fees are in US Dollars (USD)
- Payment is due immediately upon subscription
- Subscriptions auto-renew unless cancelled
- Failed payments may result in service suspension
- Price changes will be communicated 30 days in advance
5.3 Free Trials
We may offer free trials for paid plans. You will not be charged until the trial period ends. You can cancel anytime during the trial without charge.
6. Refund Policy
6.1 Monthly Subscriptions
Monthly subscriptions are non-refundable. You may cancel at any time, and your access will continue until the end of the current billing period. No refunds will be provided for partial months.
6.2 Annual Subscriptions
Annual subscriptions are eligible for a pro-rated refund if cancelled within 30 days of purchase. After 30 days, annual subscriptions are non-refundable. Upon cancellation, service continues until the end of the annual period.
6.3 Exceptional Circumstances
Refunds may be issued at our sole discretion for:
- Service outages exceeding our SLA (Enterprise customers only)
- Billing errors
- Exceptional cases reviewed on a case-by-case basis
6.4 Requesting Refunds
To request a refund, contact billing@sayify.pro within the applicable time period.
7. Cancellation
- You may cancel your subscription at any time from your account settings
- Cancellation takes effect at the end of the current billing period
- Upon cancellation, your data is retained for 30 days then permanently deleted
- You may export your data before cancellation
8. Data Ownership and Rights
8.1 Your Content
You retain all rights to voice recordings, transcriptions, and other content you create using our Service ("Your Content"). You grant us a limited license to process, store, and display Your Content solely to provide the Service.
8.2 Respondent Content
Voice responses submitted through your public links become part of Your Content. You are responsible for obtaining necessary consents from respondents and complying with applicable data protection laws.
8.3 Our Rights
We own all rights to the Service, including software, algorithms, designs, trademarks, and documentation. You may not copy, modify, or reverse engineer any part of the Service.
9. Service Level and Availability
- Uptime Goal: 99.9% uptime for paid plans (excluding planned maintenance)
- Maintenance: We may perform scheduled maintenance with advance notice
- No Guarantee: We do not guarantee uninterrupted or error-free service
- SLA: Enterprise customers may have specific SLA terms in their contracts
10. Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
- WE ARE NOT RESPONSIBLE FOR LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION
11. Indemnification
You agree to indemnify and hold harmless Sayify.pro from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Your Content or use of the Service
- Claims by respondents or other third parties
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
12.2 Arbitration
Any disputes shall be resolved through binding arbitration in Delaware, except for claims seeking injunctive relief.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via:
- Email notification to your registered email address
- In-app notification
- Posting on this page with updated "Last Updated" date
Continued use of the Service after changes constitutes acceptance of new Terms.
